Danish DPA Data Protection Digital Markets Act EU-US cooperation EDPB hits Meta, the EU General Court explains the nature

The EU-U.S. Data Privacy Framework faces criticism in Germany, Dutch DPA investigates practices of the generative AI developers.

As DPOrganizer reported last week, the EU-U.S. Data Privacy Framework was challenged before the European Union’s General Court by a French lawmaker Philippe Latombe.

Now, as Euractiv reports, these pursuits find clear support in the German Bundestag. “A legal review is not unexpected for me, since personal data from Europe do not enjoy the same level of protection in all aspects in the USA as in the EU, even after the reissue of the Privacy Shield,” Maximilian Funke-Kaiser, digital policy spokesman for the liberal FDP, told Euractiv. Besides, technology policy spokesperson for the Left Party parliamentary group Petra Sitte says that “the level of data protection in the United States is still inadequate. So it is only logical that the current agreement is also being challenged in court. The European Commission must understand that its attempts at a transatlantic data transfer agreement will only be valid if something substantial changes”, Sitte said.

Also, as Euractiv reports, NOYB announced a challenge the day the EU-US data protection framework was adopted: the “third attempt of the European Commission to get a stable agreement on EU-US data transfers will be likely back at the Court of Justice (CJEU) in a matter of months”

Meanwhile, as the IAPP reports, the U.K. government will announce an updated data transfer agreement with the U.S. today, on 21 September.

Dutch supervisory authority, Autoriteit Persoonsgegevens (AP), demands clarity from the generative AI developers as regards their data usage practices.

Special attention is paid to apps for young children in which this form of AI is applied. According to the AP’s statement, “For example, the AP has asked a tech company for clarity about the operation of the chatbot that was integrated into their app, which is popular with children. The AP wants to know, among other things, how transparent the chatbot is about the handling of user data”.

Besides, “the AP previously announced that it would take various actions towards organizations that use generative AI. This summer, the AP has queried the software developer OpenAI about how the company and the ChatGPR handle personal data when training the underlying system. In addition, the AP is part of the ChatGPT Task Force of the partnership of European privacy regulators, the European Data Protection Board (EDPB)”.
